1A. The Customer acknowledges by signing below that the customer has read the information appearing in the above shaded box and acknowledges the date the Customer received the instrument, the type of instrument, the brand name of the instrument, serial number of the instrument and the agreed upon fair market value of the instrument. This value will be the purchase price of the instrument in the event the customer chooses to purchase the instrument or in the event that the customer fails to return the instrument, or the instrument is lost, stolen or destroyed.

2. Rental Renewal. At the end of the two month (60 day) rental period, the rental will automatically be renewed at the Customer's option on a two month (60 day) basis at the same periodic rate by the continued payment. The Customer may return the instrument at the end of any rental period following the initial rental period, pay all rental fees, late fees, and Service policy fees due and owing and terminate this Rental Agreement without penalty. THERE WILL BE NO REFUND FOR EARLY RETURNS.
3. Rental Payments. Rental payments are due in advance. Monthly rentals are due every 60 days from the date that the instrument was originally rented. You will receive a formal billing statement. Rental payments are to be mailed to Randy Comeau Band Instruments, P.O. Box 2731 Santa Clarita, CA. 91386.
4. The Customer gives Randy Comeau Band Instruments authorization in the event of default by customer, to charge our bankcard or cash the check left at the time of rental as the required security deposit.
5. Purchase price. The purchase price of the instrument is the full fair market retail value of the instrument as written at the bottom of the above shaded box and is agreed to by the customer and signed above by customer.
6. Service Policy. A NON-DEDUCTIBLE Service Policy is available. The Service Policy covers ALL repairs to the instrument resulting from normal wear. The optional Service Policy covers accidental damages occurring to the instrument during normal usage but expressly excludes intentional damage, loss of or theft of the instrument, or destruction of the instrument. If the rental payment is past due the Service Policy is void.
7. If payment is 15 days late, I authorize Randy Comeau Band Instruments to charge my bank card or cash the security deposit check signed with the contract for security deposit to pay any rental fees, late fees, service charges, repairs or replacements to the instrument. Failure to enforce this clause shall not preclude any right to enforce the clause if the account remains delinquent or again becomes delinquent at a later date.
8. Late Fee. Monthly rentals will be charged a five dollar ($5) fee for each fifteen (15) days past the customers due date.
9. Security Deposit. A security deposit is required for all instrument rentals. The security deposit will be made by giving authorization to charge a valid bank card or by issuing a check for the full value of the instrument which will be retained with the contract and returned to the customer when the customers account is closed in good standing. This security deposit is to be used in case of customer default of any of the obligations of this agreement. If a security deposit check is cashed to satisfy debt due to a default, a statement shall be sent to the customer along with a refund of any deposit money in excess of the debt owed to Randy Comeau Band Instruments. If a bankcard is used for security deposit, the bankcard must be in effect for the entire rental period. If for any reason the card used at the commencement of the rental agreement is no longer valid then: a. A valid bank card number must be given; or b. The instrument must be returned to Randy Comeau Band Instruments; or c. The instrument must be paid for in full immediately.
10. PURCHASE OPTION. The customer may purchase the instrument any time throughout the life of this contract by paying the purchase price which is the value as noted above and initialed by the Customer. Up to three rental periods equaling six (6) months of paid rental fees will be credited towards the purchase price of the instrument. I, the Customer understand that no more than three rental periods (six (6) months) of rentals will be applied towards the purchase price of the instrument. Rental payments are not transferable to another rental instrument unless that instrument is of a higher value than the instrument appearing on this contract and the instrument appearing on this contract is returned in the same condition that it was in at the start of the rental agreement. Rental credit towards purchase does not apply if rental payments are past due unless the account is first paid to current status.
11. The instrument will remain the sole property of Randy Comeau Band Instruments until such time as the renter has purchased the instrument. The Customer may not sell, transfer, pawn, or otherwise give up control of the instrument as long as it belongs to Randy Comeau Band Instruments.
12. Attorney Fees. If, by reason of any default or breach on the part of the customer in the performance of any provision in this agreement a legal action is instituted, the customer agrees to pay all reasonable costs and attorney fees in connection therewith.
13. Limitation of Damages. It is agreed that in the event of breach of any warranty, express or implied, the liability of the lessor shall be limited to repairing or replacing the nonconforming goods. Randy Comeau Band Instruments SHALL NOT BE LIABLE FOR ANY OTHER DAMAGES, EITHER DIRECT OR CONSEQUENTIAL.
14. The Customer agrees that he/she will return the instrument in the same condition that it was received at the start of the rental. . The Optional Service Policy covers accidental damages to the instrument but expressly excludes intentional damage, loss of or theft of the instrument, or destruction of the instrument. Unless the Service Policy is purchased, the Customer hereby agrees to assume all liability for all repairs to the instrument.

15. The Customer is solely responsible for the fair market value of the instrument as listed above an initialed by the customer, if it is lost, stolen, damaged, or destroyed, unless such damage is covered by the Service Policy.
16. Privacy policy. No information will be given or sold to anyone for commercial purposes. In the event the customer defaults on the contract, all information will be given to law enforcement agencies, credit reporting agencies and the courts to facilitate legal action if necessary. All information will be considered confidential accept the information needed by the credit card company to complete billing, the information requested by law enforcement, supplied to collection agents, courts and the information supplied to credit bureaus in the event the customer defaults on the contract.
17. The instrument must be returned or purchased, all rental payments, late charges and Service Policy fees must be paid before this contract between the Customer and Randy Comeau Band Instruments is terminated. Instruments will be considered on rental until repair work is completed and paid for by the Customer if the instrument is returned damaged, unless the instrument is covered by the Service Policy. NOTICE: Failure to promptly return rental property may result in collection activity and or a criminal prosecution as provided by law. You may also be reported to a collection agency, which will affect your overall credit rating.
By signing this agreement, the Customer states that he/she has read and understands this agreement in its entirety. Customers should print a duplicate copy of this contract for their records. A copy will be included with the instrument when rented.
